These Terms and Conditions of Service and Use of www.nuwater.life (the “Terms and Conditions“) are hereby made effective (nuwater.life)” or “we” or “us” or “our“), and, without waiving or otherwise releasing any right or obligation under any prior terms and conditions of the use of “NÜWATER”, hereby amend and restate any such prior terms and conditions.

NU WATER TRADING L.L.C maintains the www.nuwater.life website (“Site”)

In consideration of each member or customer’s (each, a “customer” or “you“) access to and use of the Site, we require every members and customer to act with integrity, to our rules for the Site, and to abide by these Terms and Conditions and each other rule, regulation or other policy of “NÜWATER”, (nuwater.life). 

1. SITE OPERATION: United Arab Emirates is our Country of Domicile. NÜWATER controls this Site from the U.A.E. NÜWATER makes no representation that this Site is appropriate for use in other locations. If you use this Site from other locations you are responsible for ensuring compliance with local laws. You may not use, export or re-export any materials from this Site in violation of any applicable laws or regulations, including, but not limited to any U.A.E export laws and regulations. 

APPLICABLE LAW. The Laws of the United Arab Emirates shall govern the use of the Site and the Terms of Use, without regards to conflict of laws principals. All disputes arising in connection therewith shall be heard only by a court of competent jurisdiction in U.A.E. 

2. MULTI-CURRENCY PRICED TRANSACTION, the displayed price and currency selected by you, will be the same price and currency charged to the Card and printed on the Transaction Receipt.

PURCHASES. NÜWATER accepts payment by Visa or Mastercard debit and credit cards in AED for its products and services. All online purchases are also governed by the terms and conditions of respective merchant service providers. Please review respective merchant service provider’s user agreement and privacy policy before entering any transaction. Interpretation. These Terms of Use supersede all other written and oral communications or agreements with regard to the subject matters discussed in these Terms of Use. A waiver or modification of these Terms of Use will only be effective if made in writing signed by an authorized officer of NÜWATER. All refunds will be made onto the original mode of payment.

PAYMENT CONFIRMATION. Once payment is made, the confirmation notice will be sent to the user via the provided email at time of purchase. No later than 24 hours after time of payment. 

3. OFFICE FOREIGN ASSETS CONTROL (OFAC) SANCTIONED COUNTRIES. NÜWATER will not trade with or provide any services to individuals and companies owned or controlled by, or acting for or on behalf of, OFAC targeted countries AND individuals, groups, and entities, such as terrorists and narcotics traffickers designated under the OFAC programs that are not country specific

4. REPRESENTATIONS BY YOU. By visiting the Site, you represent, warrant and covenant that (a) you are at least 18 years old; (b) that all materials of any kind submitted by you to NÜWATER through the Site or for inclusion on the Site will not plagiarize, violate or infringe upon the rights of any third-party including trade secret, copyright, trademark, trade dress, privacy, patent, or other personal or proprietary rights. The customer using the website who are Minor /under the age of 18 shall not register as a User of the website and shall not transact on or use the website.

5. PERMITTED USE. You agree that you are only authorized to visit, view and to retain a copy of pages of this Site for your own personal use, that you shall not duplicate, download, publish, modify or otherwise distribute the material on this Site for any purpose other than for personal use, unless otherwise specifically authorized by NÜWATER to do so. You also agree not to deep-link to the site for any purpose, unless specifically authorized by NÜWATER to do so. The content and software on this Site is the property of NÜWATER. The cardholder must retain a copy of transaction records and Merchant policies and rules.

6. YOUR ACCOUNT. If you use NÜWATER Site, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your account from any devices, and you agree to accept responsibility for all activities that occur under your account or password. The Site shall not be responsible or liable, directly or indirectly, in any way for any loss or damage of any kind incurred as a result of, or in connection with, your failure to comply with this section.

NO COMMERCIAL USE. This Site may not be used by you for any commercial purposes such as to conduct sales of merchandise or services of any kind. You must obtain NÜWATER’s prior written consent to make commercial offers of any kind on the Site, whether by advertising, solicitations, links, or any other form of communication. NÜWATER will investigate and take appropriate legal action against anyone who violates this provision, including without limitation, removing the offending communication from the Site and barring such violators from use of the Site.

All titles, ownership and intellectual property rights in the website and its content shall remain with the Company, its affiliates, agents, authorized representatives or licensor's as the case may be.

All rights not otherwise claimed under this Terms and Conditions or by the Company are hereby reserved. The information contained in this web site is intended, solely to provide general information for the personal use of the reader, who accepts full responsibility for its use.

PAYMENT AND PRICES

Prices for products are quoted on the item listing. Our shop contains a large number of products and it is always possible that some of the prices on the website may be incorrect. We will verify prices as part of our sale procedures so that a product's correct price will be stated when you pay for the product. In addition to the price of the products, you may have to pay a delivery charge, which will be as stated when you pay for the product.

Product descriptions, typographic, pricing and photographic errors are unintentional and subject to correction. We regret, but are not liable for such errors. We reserve the right to reject any orders placed for a product listed at an incorrect price. If you discover an error in our website or catalog, please let us know.

Prices for products are liable to change at any time, but changes will not affect contracts which have come into force. If you dispute any payment made to us you must contact us immediately and provide full details of your claim.

Before you place your order, you will have the opportunity of identifying whether you have made any input errors by checking the order details. You may correct those input errors before placing your order by editing your shopping cart and/or customer details.

We have made every effort to display as accurately as possible the colors and images of our products that appear at the store. We cannot guarantee that your computer monitor's display of any color will be accurate. We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

SHIPPING

We will arrange for the products to be delivered to the address for delivery indicated in your order by courier.

However, we cannot guarantee delivery by the relevant date. We do however guarantee that unless there are exceptional circumstances all deliveries of products will be dispatched within 7 days of the later of receipt of payment and the date of our order confirmation.

Although we endeavour to make sure all products listed on our website are currently in stock and pricing is true and correct, an ordered item may not be available. We will contact you, in case the product is not available.

WARRANTY

You represent and warrant that if you are making online payments that (i) any credit card, debit card and bank account information you supply is true, correct and complete, (ii) charges incurred by you will be honored by your credit/debit card company or bank, (iii) you will pay the charges incurred by you in the amounts posted, including any applicable taxes, and (iv) you are the person in whose name the card was issued and you are authorized to make a purchase or other transaction with the relevant credit card and credit card information.

You warrant to us that:

(a) You have full authority, power and capacity to agree to these terms of sale;

(b) The information provided in your order is accurate and complete;

(c) You will be able to accept delivery of the products;

REFUNDS AND CANCELLATIONS

We apologize for any inconvenience but due to the nature of the products we do not provide refunds or replacements to any of our products once they have been delivered to you.

Once the order is processed, we cannot cancel the order or make changes to the shipping address. You are advised to verify your shipping address mindfully before placing your order.

FORCE MAJEURE

Neither party hereto shall be responsible for delays or failures in performance resulting from acts beyond its reasonable control and without its fault or negligence. Such excusable delays or failures may be caused by, among other things, strikes, lock-out, riots, rebellions, accidental explosions, floods, storms, acts of God and similar occurrences.

GOVERNING LAW AND JURISDICTION

These Terms and Conditions will be governed by and construed in accordance with UAE law, and the courts of UAE will have non-exclusive jurisdiction to adjudicate any dispute arising under or in relation to these terms of sale.

Notwithstanding anything else set forth in this website, any and all claims, actions, disputes and lawsuits relating in any way, directly or indirectly, to this website, including but not limited to accessibility, services and products related to this website, shall be governed by and construed in accordance with the internal laws of the UAE without giving effect to any choice or conflict of law provision or rule that would cause the application of laws of any jurisdiction.

Any claim, action, lawsuit or proceeding arising out of or related to this website and the services and products provided, shall be instituted exclusively in the federal courts of the UAE  and the user hereof irrevocably submits to the exclusive jurisdiction of such courts in any claim, action, lawsuit or proceeding, and waives any objection based on improper venue.

REFUSAL OF YOUR ORDER

While we will use our best efforts to fulfill all orders, we cannot guarantee the availability of any particular product displayed on the Site. We reserve the right to discontinue the sale of any product listed on the Site at any time without notice.

The receipt of an order number or an email order confirmation does not constitute acceptance of an order or a confirmation of an offer to sell.
